Terms of use

Truth or Dare: Never Ever is offered by Miguel Gamarra, an individual, at Proviv. Res. La Esperanza, Carabayllo, Lima 15121, Peru. These terms are the agreement between you and that person for using the app: by downloading or using it you accept them, and if you do not accept them, do not use it.
What we allow
We grant you a personal, non-exclusive, non-transferable license to use the app on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules.
The app, its design and its cards are ours. The cards you write yourself are yours and stay on your phone.
For adults 18 and over only
Everyone who plays must be 18 or older. The highest levels get flirty, never explicit.
How it is played
It is a game, and nobody has to do anything:
- Any card can be skipped, with no explanation, and a “no” always counts.
- Dares with someone else, only if they want to. If they do not, skip it.
- Nothing dangerous, illegal or humiliating. If a dare could hurt someone, it is not done.
- Your own cards are the responsibility of whoever writes them. The app’s cards never ask for alcohol, drugs, undressing, or writing or posting anything about people who are not playing, and yours should not either.
What each person does
Everyone is responsible for what they do while playing. If one of the app’s cards does not feel right, skip it and tell us which one: we will review it.
Apple
This agreement is between you and us, not with Apple. We alone are responsible for the app and its content, for its maintenance and support, and for addressing any claim about it: product liability, failure to conform to a legal or regulatory requirement or to consumer protection law, or infringement of a third party’s intellectual property rights. Apple has no obligation to provide any maintenance or support for the app.
If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price you paid for it; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
By using the app you represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
When using the app you also comply with any third-party terms that apply to you (for example, your carrier’s). Apple and its subsidiaries are third-party beneficiaries of this agreement: once you accept it, Apple may enforce it against you.
Warranty and liability
The app is provided as is. We do our best for it to work, but we do not guarantee that it will always be available or free of errors. To the extent permitted by law, we are not liable for indirect damages from using it or being unable to use it, nor for what players do. Nothing here limits the rights that the law of your country gives you as a consumer.
Changes and ending the agreement
If we change these terms, the date above changes. You can stop using the app and delete it at any time; the agreement also ends if you break these terms.
These terms are governed by Peruvian law, and for anything that is not a consumer matter the courts of Lima, Peru have jurisdiction. If you are a consumer, this takes nothing away from you: you keep the protection of the mandatory rules of the country where you live and may bring a claim before the courts of your own domicile.
